Only the Equality and Human Rights Commission (EHRC) can confirm whether your complaint may be suitable for referral to our Equalities Mediation Service. The EHRC must first make sure that there is a legal basis for the complaint and that mediation is the best way forward.
We can take referrals from certain third party organisations ( for more information click here) or from individuals but we will need approval from the EHRC before we can proceed.
Initially, the EHRC Casework and Litigation team will consider whether;
- the complaint falls within the scope of the relevant act
- the client’s preferred resolution is likely to be achievable through mediation
- any reasonable potential resolutions have already been suggested by the other party
- the complaint has been raised within a reasonable time frame
- in employment cases, the complainant is still employed by the other party in the complaint.
If you, or your organisation, have received a complaint in relation to an allegation of discrimination, we will be happy to talk to you. Although we can only accept referrals from the complainant you may find it helpful to approach them with a suggestion that they request mediation.
