How the process works

Step by step

  1. We receive a referral from the Equalities and Human Rights Commission (EHRC) which has checked that the case is suitable and agreed to fund it
  2. Our case co- ordinator contacts both parties and explains what can happen next
  3. An agenda for the mediation meeting is prepared. This is a list of the items that the complainant feels would need to be achieved in order to resolve the dispute. This list is sometimes called the ‘desired agreements’
  4. The agenda is shared with the respondent who has an opportunity to comment or ask questions.
  5. The mediator is appointed and the mediation meeting is arranged. The parties agree who needs to be at the meeting and where and when it should be held
  6. At the meeting the mediator manages the discussions with the aim of reaching a practical and realistic agreement that will resolve the individual complaint  and prevent the situation happening again 
  7. The agreement is recorded as a ‘Full and Final Settlement’.
